Around 2.1 GW modules for solar projects representing a total investment of about $2.2 billion held presently by the Customs and Border Protection (CBP). It will potentially affect 3,000 construction workers. The Customs implementing this action was to stop the flow of goods produced using forced labor in China’s Xinjiang region.
A few companies have had 50 to 100MW of modules detained by customs agents. One of the companies is “not able to ship from Malaysia to the U.S.” Independent sources name three companies that had modules detained by border agents. The attorneys believe there was a “low likelihood” that any detained modules would be released. Affected importers have three months to prove that forced labor camps were not involved, including any stage of the production process.

On the one hand, President Biden has issued statements opposing forced labor in supply chains. But, on the other hand, Biden is pushing for a rapid expansion of green energy resources, including solar. Recently, the White House said that solar deployment would need to accelerate up to four times faster than today to meet clean energy targets by 2035.
Suppliers that can provide documentation should have no issue at the border. Also, the Biden Administration will work out the kinks in the CBP’s actions and fine-tune the process. Then we can all get back to building projects and not bother about what our government policy is doing unless it benefits our industry.
